The personal data processed through the website is provided directly by the user through the forms made available for that purpose, or through the communication channels detailed in each section of the site.

The user warrants that the data provided is true, accurate and complete, and undertakes to keep it duly updated so that it reflects their actual situation. The user must notify CustomsGo as soon as possible of any changes or corrections to their personal data by sending an email to: protecciondatos@customsgo.com. Likewise, by clicking the "I accept" button or its equivalent included in the Website forms, the user declares that the information and data provided therein is accurate and truthful.

Where the user provides third-party data, they declare that they have a legal basis for doing so and undertake to pass on the information contained in this privacy policy to that third party, releasing CustomsGo from any liability in this respect. Nevertheless, CustomsGo may carry out checks to verify this, applying the corresponding due diligence measures in accordance with data protection legislation.

Fields marked with an asterisk (*) in the forms available on the Website are necessary in order to carry out the purpose for which the data is collected. If the user does not provide them, the processing cannot be carried out — for example, in the case of the general contact form.

Although merely visiting and browsing this website does not cause CustomsGo to automatically record data that identifies users by name, certain information may be collected and stored in CustomsGo systems — for example, the type of internet browser, operating system and IP address from which the Website pages are accessed — in order to improve the user’s browsing experience and the management of the Website itself.

In view of the different purposes and processing activities carried out through the Website and the contact channels specified on it, CustomsGo will process the following categories of personal data:

• Identification and contact data: first name and surname, email address, company and telephone number.
• Employment details: professional category, job title, the company where the user works and corporate contact details.
• Academic and professional data: where the user sends us their CV or is interested in one of the recruitment processes carried out at CustomsGo, data relating to education and qualifications, academic record, professional experience and membership of professional bodies or associations may be processed.
• Data used to build a profile: information relating to the use of the Website.
• Browsing data: IP address, advertising ID and the user’s behaviour on the Website.
• Other data: provided directly by the user in communications held through the channels made available for that purpose.

The Website offers a private area that CustomsGo clients may access. Once logged in, the client can complete their personal information there. The purpose of registering as a user is to allow access to exclusive content and services. The legal basis for the processing is the contractual relationship arising from registration as a user of the private area of the Website. The data provided will be retained for as long as the user remains a client.

CustomsGo will process the data provided by the user for the following purposes:

• To manage and respond to contact requests made by the user, whether through the forms provided for that purpose on the Website, through corporate email addresses or through other indicated means of contact.
• To send commercial and/or promotional information related to the sector of the services contracted and of added value to end users, by electronic and/or conventional means, unless otherwise indicated or unless the user objects or withdraws their consent.
• Where the user sends their CV, their data will be processed in order to assess and manage their job application and, where applicable, to carry out the actions necessary for staff selection and recruitment, so as to offer them positions matching their profile, both at CustomsGo and at the other companies associated with the CustomsGo brand.
• To produce anonymous statistical reports on access habits, preferences and user behaviour on the Website.
• To comply with legally established obligations, and to verify compliance with contractual obligations, including fraud prevention.

CustomsGo processes user data on the following legal bases:

• Managing and responding to contact requests: the processing arising from this purpose is based on consent, which the user may withdraw at any time. If the user withdraws consent, the query or matter raised cannot be processed.
• Participation in recruitment processes: where the user sends their CV or applies for the various vacancies: if the application is unsolicited, their data will be processed on the basis of consent.
• Producing anonymous statistical reports: all processing arising from this purpose is based on legitimate interest, which data protection legislation recognises for the controller. This legitimate interest lies in being able to offer users the CustomsGo services with the highest possible quality and the best possible experience.
• Complying with legally established obligations: all processing arising from this purpose is based on compliance with a legal obligation.

The consents obtained for the purposes mentioned above are independent of one another, so the user may withdraw just one of them without this affecting the others.

The user’s personal data will be retained by CustomsGo for the following periods:

• Managing and responding to contact requests: the data will be retained for the period necessary to process and respond to the request and, once that period has ended, it will be kept blocked for the limitation period of any legal actions arising from that request.
• Processing of job application data: where the user sends their CV, the data will be processed for a period of one year. If the applicant is hired, the data will be incorporated into the set of data processed for the performance of the employment relationship and will be governed by the terms of the employment contract with CustomsGo.
• Producing anonymous statistical reports: the information will be used in aggregated form to produce reports, statistics and analyses, for the period necessary to process and produce those reports, statistics and/or analyses and, once that period has ended, it will be kept blocked for the limitation period of any legal actions arising from that request.
• Complying with legally established obligations: the data provided in order to comply with the obligations arising from the services offered by CustomsGo will be retained for the periods established by law.

CustomsGo informs the user that their data may be disclosed to companies associated with CustomsGo in order to handle their request for information, manage the services they contract and inform them about services, as well as to take part in recruitment processes within the CustomsGo Group, all on the basis of the legitimate interest recognised in Article 48 of the General Data Protection Regulation.

Some of those recipients may be located inside or outside the European Economic Area, depending on the geographical location of the CustomsGo group companies providing services; in the latter case, the international data transfers are duly authorised.

In addition, we inform you that certain data may, under the applicable legislation or the contractual relationship in place, be disclosed to:

• Public authorities, in the cases provided for by law, on the basis of compliance with a legal obligation.
• Courts and tribunals, in the cases provided for by law, on the basis of compliance with a legal obligation.
• State law enforcement agencies, in the cases provided for by law, on the basis of compliance with a legal obligation.
• Banks and financial institutions, for collecting payment for the services provided by CustomsGo to its clients.
• Other legal professionals, where such disclosure is required by law or necessary for the performance of the contracted services.
• In addition, CustomsGo may work with third-party web service providers that may have access to your personal data, which they will process on behalf of and for the account of CustomsGo, following rigorous supplier selection procedures in order to comply with its data protection obligations, including the signing of the corresponding data processing agreement in accordance with Article 28 GDPR.

In line with CustomsGo’s commitment to the protection of personal data and user privacy, the necessary security measures have been adopted to prevent loss, manipulation, disclosure or alteration of data — such as encryption of communications between the user’s device and CustomsGo servers, encryption of information on the CustomsGo servers themselves, and other measures preventing third-party access to user data.

By writing to CustomsGo at the email address protecciondatos@customsgo.com, the user may exercise the following rights at any time and free of charge:

a) Right of access

You have the right to have CustomsGo inform you whether or not it is processing your personal data and, if so, to access that data and receive information on the purposes for which it is processed, the categories of data concerned, the recipients to whom your personal data has been disclosed and the envisaged retention period, among other information.

b) Right to rectification and erasure

You have the right to request the erasure of personal data where the legal requirements are met, and the rectification of inaccurate data concerning you where, among other reasons, it is no longer necessary for the purposes for which it was collected.

c) Restriction of processing, withdrawal of consent and objection

In certain circumstances — for example, where the applicant contests the accuracy of their data, while that accuracy is being verified — you may request the restriction of the processing of your personal data, which will then only be processed for the establishment or defence of legal claims.

You also have the right to withdraw the consent given and to object to the processing at any time, on grounds relating to your particular situation, where the processing is based on our legitimate interest or on the legitimate interest of a third party, including processing for direct marketing purposes and the related profiling. In that case, CustomsGo will cease processing unless it can demonstrate compelling legitimate grounds.

d) Right to data portability

You have the right to receive the personal data you have provided to CustomsGo in a structured, commonly used and machine-readable format, and to transmit it to another controller without hindrance from the controller to which it was provided, in the cases legally provided for.

e) Automated individual decision-making

In addition to the rights mentioned above, where automated decisions are taken, including profiling, you have the right to obtain human intervention on the part of CustomsGo, to express your point of view and to contest the decision.

f) Other

Likewise, where personal data is transferred to a third country or to an international organisation, you have the right to be informed about how to access or obtain a copy of the appropriate safeguards relating to the transfer. You may also lodge a complaint concerning the protection of your personal data with the Spanish Data Protection Agency (Agencia Española de Protección de Datos) at C/ Jorge Juan, 6, 28001 - Madrid, where you consider that CustomsGo has infringed the rights granted to you by the applicable data protection legislation.

CustomsGo will only use data storage and retrieval devices ("cookies") where the user has given prior consent, in accordance with the pop-up window shown in the user’s browser on first access to the Website and with the other terms and conditions set out in the CustomsGo Cookie Policy, which every user should be aware of.

The Website offers a private area accessible to CustomsGo clients who have requested access from the Sales Department. Once logged in with their email address and password, the client can access all data relating to their shipments. Registration as a client can only be carried out through the Sales Department, and its purpose is to provide access from that area to information exclusive to the client. The legal basis for the processing is the contractual relationship between the client and CustomsGo. The data provided will be retained for as long as the contractual relationship continues. This Privacy Policy applies in full to the processing of that data.

To ensure that its data protection guidelines always meet current legal requirements, CustomsGo reserves the right to make any changes needed to remain aligned with the legislation in force at any given time.
